A Decide has warned a Stranorlar man with 23 earlier convictions that he’s in a ‘cycle that must be damaged’.

Tristan McAteer was given the strict warning by Decide Éiteáin Cunningham when he appeared charged with public order offences.

Garda needed to deploy pepper spray and handcuff McAteer throughout the incident at Kernan’s store in Castlefin on January 19, 2024.

Sergeant Gerard Dalton instructed the courtroom that gardai acquired a report of an altercation outdoors the store. Upon their arrival, gardai noticed McAteer who was mentioned to develop into ‘aggressive and abusive’ to officers.

Sergeant Dalton mentioned McAteer known as gardai ‘various names’. He mentioned McAteer ‘remained abusive and aggressive to gardai always’.

Mr Frank Dorrian, representing McAteer, mentioned the accused, a 35-year-old of Hilltop Crescent, Drumboe, Stranorlar, has an underlying problem of alcohol abuse ‘and, every now and then, different substances’.

“His life has been peppered by visits to courtroom,” Mr Dorrian mentioned. “He realises that he can’t deal with alcohol. One drink results in one other and he finds himself on the garda station on the finish of those encounters.”

Mr Dorrian mentioned McAteer is seeing a counsellor and making an attempt to get a spot at White Oaks.

“So long as he finds himself consuming, he’ll discover himself earlier than the courtroom,” Mr Dorrian mentioned. “I requested him on one event when he was going to jail how lengthy it might be after launch when he would discover himself in an off licence and he mentioned: ‘Inside an hour’. That angle is now now not current.”

Decide Éiteáin Cunningham requested for a probation report to incorporate McAteer’s suitability for group service.

The case was adjourned till March 25.
